1.Intermediary Safe Harbor & Overview
Locky is an ephemeral, automated digital communications intermediary. Users upload encrypted, time-limited media that automatically self-destructs after 24 hours. Under the Digital Millennium Copyright Act ("DMCA", 17 U.S.C. § 512) and the Communications Decency Act (47 U.S.C. § 230), Locky acts strictly as a service provider and maintains a strict, expeditious notice-and-takedown system.
2.Designated Copyright Agent
Pursuant to 17 U.S.C. § 512(c), notifications of claimed copyright infringement must be sent to Locky's Designated Copyright Agent:

3.Filing a DMCA Notice of Infringement
To be effective under 17 U.S.C. § 512(c)(3), a notification must be in writing and include all of the following statutory elements:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
- Identification of the material claimed to be infringing or to be the subject of infringing activity, specifically including the complete URL (e.g.,
https://locky.evencheng.com/v/XXXX) or Vault ID. - Information reasonably sufficient to permit Locky to contact the complaining party (name, address, telephone number, and email address).
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
4.Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i)(1)(A), Locky maintains an automated policy that provides for the termination, blocking, and IP-level restriction of users or automated agents that repeatedly violate copyright or abuse policies.
5.Law Enforcement Guidelines & 18 U.S.C. § 2703
Locky cooperates with authorized U.S. federal and state law enforcement agencies conducting lawful criminal investigations:
- Child Sexual Exploitation (18 U.S.C. § 2258A): Locky reports all apparent instances of child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) CyberTipline immediately upon discovery.
- Zero-Database Architecture: Locky does not require user accounts, email addresses, names, or phone numbers. We store only ephemeral media objects that self-destruct in 24 hours.
- Formal Legal Process: Except in verifiable life-threatening emergency situations, Locky requires a valid subpoena, court order under 18 U.S.C. § 2703(d), or search warrant under Rule 41 to disclose non-public transactional records.
- Preservation Requests: Pursuant to 18 U.S.C. § 2703(f), official law enforcement preservation requests must be addressed to our legal desk at abuse@evencheng.com and must specifically cite the Vault ID or URL before its 24-hour expiration.
